القيمة القانونية لاعتراض المدين على الدين في التشريع الأردني وأثره مدنيا و جزائياً

Abstract

This research has dealt with the subject of the debtor's objection to the debt and may be particularly important in view of the importance of official bonds and ordinary bonds in day-to-day transactions to establish the rights and obligations of any source. and the importance of this topic is heightened by legislative amendments to the debtor's debt objection mechanism by falsification, claim of performance and denial of signature, It is necessary to identify these amendments and indicate the effect of the objection to these bonds.

With this research, we have concluded a series of findings and recommendations, most notably that the legislator gave official bonds an argument to all that can only be challenged by falsification on the basis of trust in the public servant and the lack of interest in changing the content of the bond. We wish the Jordanian legislator to expressly provide for specific compensation to the creditor in the event that the debtor intends to challenge or proceed if the action is malicious.

الملخص العربي

تناول هذا البحث موضوع اعتراض المدين على الدين ولعل بحث هذا الموضوع يتميز بأهمية خاصة نظراً لأهمية السندات الرسمية و السندات العادية في المعاملات اليومية لاثبات الحقوق و الالتزامات أيا كان مصدرها ، وتتعاظم أهمية هذا الموضوع في ظل التعديلات التشريعية على آلية اعتراض المدين على الدين بالتزوير و ادعاء الوفاء و إنكار التوقيع ، إذ بات من الضروري الوقوف على هذه التعديلات وبيان أثر الاعتراض على هذه السندات

خلصنا بهذا البحث إلى مجموعه من النتائج و التوصيات ومن أبرزها أن المشرع أعطى السندات الرسمية حجة على الكافة فلا يجوز الطعن بها إلا بالتزوير إستناداً إلى الثقة في الموظف العام و عدم جود مصلحة له في تغيير مضمون السند ، فعلى المشرع الأردني النص صراحةً على تعويض محدد للدائن في حالة إذا ما قصد المدين من الاعتراض أو المماطلة إذا كانت الدعوى كيدية.
