المواجهة التشريعية والأمنية لجرائم الذكاء الاصطناعي في دولة الكويت (دراسة تحليلية)

Abstract

The study aimed to demonstrate the mechanisms of legislative and security confrontation of artificial intelligence crimes. The use of technologies associated with artificial intelligence may go beyond the imposed limits, whether by exploiting it through its program developers & specialists to commit crimes in the cyber field, or it may be with the growing capabilities of artificial intelligence to make decisions in the field. Many behaviors occur automatically. Our research also aims to study the criminal responsibility for these crimes, & determine it in order to hold the real perpetrator accountable in accordance with the legal rules in force to criminalize these criminal patterns. This topic raises a number of challenges related to determining liability when artificial intelligence commits a criminal offense, including granting artificial intelligence entities legal personality & the ability of statutory laws to keep pace with increasing developments in the field of this technology.

-The analytical approach was used to determine the criminal effects of this problem. This approach is the closest to this type of study. This study reached several results, the most notable of which are:

- The legal prosecution of this criminal activity that accompanies this use is still in the process of research & diligence in an attempt to address these risks. The security institution or organization is the first institution responsible for this confrontation, which places on its shoulders the greatest responsibilities in this field. Through the results, the study can recommend the necessity of conducting a special review in the field of criminalizing the actions of robots & those responsible for them. We also recommend that an optimal diagnosis of the phenomenon of crimes resulting from actions related to the uses of artificial intelligence imposed by modern technology must be established & combated in terms of criminalization & punishment on the one hand, Also, the establishment of responsibility and legal personality on the other hand, the necessity of seeking the assistance of technical experts in this field, also the necessity of international cooperation (between departments The International Criminal Police (among all countries) in this important technical field, especially since crime in this field may exceed a single geographical scope. This means the necessity of joint cooperation at the international & regional levels.

الملخص العربي

هدفت الدراسة لبيان آليات المواجهة التشريعية والأمنية لجرائم الذكاء الاصطناعي، فقد يخرج استخدام التقنيات المرتبطة بالذكاء الإصطناعي عن الحدود المفروضة، سواء عن سبيل استغلاله من خلال واضعي برامجه والمتخصصين فيه بارتكاب جرائم في المجال السيبراني، أو قد يكون مع تنامي قدرات الذكاء الاصطناعي على اتخاذ القرار في كثير من التصرفات التي تحدث بصفة تلقائية. كما يهدف بحثنا هذا إلى دراسة المسؤولية الجزائيــة لتلك الجرائم، وتحديدها لأجل محاسبة الجاني الحقيقي وفقًا للقواعد القانونية المعمول بها لتجريم هذه الأنماط الإجرامية. يثير هذا الموضوع مجموعة من التحديات المتعلقة بتحديد المسؤولية عندما يرتكب الذكاء الاصطناعي جريمة جنائية، بما في ذلك منح الكيانات الذكاء الاصطناعي يعتبر شخصية قانونية وقدرة القوانين الوضعية على مواكبة التطورات المتزايدة بمجال هذه التقنية.

- وتم استخدام المنهج التحليلي لمعرفة الآثار الإجرامية لهذه الظاهرة؛ حيث إن هذا المنهج هو الأقرب لمثل هذا النوع من الدراسات. وتوصلت هذه الدراسة لعدة نتائج أبرزها:

- أن الملاحقة القانونية لهذا النشاط الإجرامى المواكب لهذا الاستخدام ما زال في طور البحث والاجتهاد في محاولة للتصدي لتلك المخاطر. وأن المؤسسة أو المنظمة الأمنية هى المؤسسة الأولى المسؤولة عن هذه المواجهة وهو ما يترتب على كاهلها أعظم المسؤوليات في هذا المجال. ومن خلال النتائج يمكن للدراسة بأن توصي بضرورة القيام بمراجعة خاصة بمجال تجريم أفعال الروبرت (الإنسان الآلي) والقائمين عليه. كما نوصي بأنه يجب وضع تشخيص أمثل لظاهرة الجرائم الناجمة عن الأعمال المرتبطة باستخدامات الذكاء الاصطناعي والتي فرضتها التكنولوجيا الحديثة ومكافحتها على صعيد التجريم والعقاب من ناحية، وإقرار المسؤولية والشخصية القانونية من ناحية أخرى، ضرورة الاستعانة بالخبراء المتخصصين بالتقنية بهذا المجال، وضرورة التعاون الدولي ( بين إدارات الشرطة الجزائية الدولية بين جميع الدول) في هذا المجال التقني الهام، خاصة وأن الجريمة في هذا المجال قد تتعدى النطاق الجغرافي الواحد، وهو ما يعني ضرورة التعاون المشترك على المستوى الدولي والإقليمي.
