التحقيق الإداري كضمانة إجرائية لصحة القرار التأديبي في النظام الشرطي لدولتي الإمارات العربية المتحدة وجمهورية مصر العربية

Abstract

The administrative investigation procedure in the police field was addressed According to the laws of the police force and security in the United Arab Emirates, as well as the Egyptian police authority, this research presents a statement of the concept of the administrative investigation procedure, the disciplinary violations subject to it, and the procedural guarantees required for its validity. This includes the powers of referral to such procedures, as well as the processes for conducting and concluding them.

The research was structured into two main topics, The first addressed the definition and nature of the administrative investigation procedure, The second focused on the guarantees necessary for its validity.

Based on this analysis, the research concluded with a set of results and recommendations aimed at achieving the desired improvements in the implementation of these procedures. balance between the administration's right to decide on disciplinary accountability, and then impose punishment if it is proven that a police member has committed any of the disciplinary violations specified exclusively, and his right to provide guarantees in the investigation with him that lead to the justice of the penalty imposed on him.

تم تناول إجراء التحقيق الإداري في المجال الشرطي وفق قانوني قوة الشرطة والأمن بدولة الإمارات العربية ، وهيئة الشرطة المصري من خلال بيان لمفهوم هذا الإجراء والمخالفات التأديبية محل اتخاذه ، والضمانات الإجرائية الواجب توافرها لصحته، من حيث سلطتي الإحالة إليه وإجراءات سيره والتصرف فيه، وقد كان ذلك على مدار مبحثين انطوى أولهما على تحديد لماهية إجراء التحقيق الإداري.

وثانيهما حوى ضمانات صحته ، حيث خلص البحث من ذلك إلى نتائج وتوصيات من شأن العمل بها تحقيق التوازن المنشود بين حق الإدارة في تقرير المساءلة التأديبية، ومن ثم توقيع العقاب حال ثبوت ارتكاب منتسب الشرطة لأي من المخالفات التأديبية المحددة على سبيل الحصر ، وبين حقه في توفير الضمانات في التحقيق معه والمؤدية إلى عدالة الجزاء الموقع عليه .
